Elberton Property 15 Pty Ltd ACN 672 202 416 (we, us, our) is the developer of the Biddle Ridge development project.  We conduct our business in accordance with the Australia Privacy (APPs) in the Privacy Act 1988 (Cth) (Privacy Act). We understand the importance of, and are committed to, protecting your personal information.  This Privacy Policy explains how we manage your personal information (that is, information or an opinion, whether true or not, about an individual who is identified or is reasonably identifiable), including our obligations and your rights in respect of our dealings with your personal information.

Please take a moment to read our Privacy Policy as it describes what happens to your personal information that is collected in the course of our business, including via our website at www.biddleridge.com.au.

Property developments under the 'Elberton' brand may be conducted separate entities (Special Purpose Vehicles or SPVs), coordinated by Elberton Property Pty Ltd ACN 122 581 748 (Elberton Property).  Elberton Property and each SPV will maintain their own privacy policies with respect to the manner in which they handle personal information, separate from this document.  Please refer to the Elberton Property website at www.elberton.com.au for its privacy policy, and to individual development websites for SPV privacy policies.

1. How we collect and hold your personal information

Any personal information we collect and hold about you will be collected in a fair and lawful manner, and not in an intrusive way. 

We may collect personal information from various sources.  Where it is reasonably practical to do so, we will collect your personal information directly from you through some of the following means:

(a) when you meet with us (when you might inform us of your personal details);

(b) when you communicate with us, including by letter, telephone or email;

(c) when you engage with our staff at any of our developments;

(d) if you attend or otherwise participate in any events that we organise; and

(e) otherwise deal with you in the course of our business.

When you submit an enquiry via our Website (including through the "Contact Us" or similar forms) or use the contact details on our Website, your personal information is collected by our appointed real estate agents, sales agents or authorised representatives, who independently manage and respond to all enquires relating to the development.

These agents are engaged by us for the purpose of marketing, enquiring handling and sales management for the development and will use your personal information to respond to your request and may contact you directly in relation to the development.  Any personal information collected will be handled in accordance with the applicable real estate agent, sales agent or authorised representative's privacy policy.

We may also collect personal information from publicly available sources and other third parties engaged by us such as:

(a) Elberton Property and other SPVs;

(b) our appointed real estate agents, sales agencies and representatives;

(c) our suppliers, contractors, consultants or professional advisers involved in our developments;

(d) recruitment agencies and personal referees.

If we collect personal information about you from a third party we will, where appropriate, request that the third party inform you that we are holding such information, how we will use and disclose it, and that you may contact us to access, correct or update the information.

2. Types of personal information we collect

The type of personal information we may collect can include (but is not limited to), your name, postal address, email address, phone numbers, billing information and, if applicable, employment information.

We do not generally collect sensitive information (which may include, for example, information about an individual's racial or ethnic origin, political opinions, religious or philosophical beliefs, professional association or trade union membership, sexual orientation, criminal record, or health or disability).

If collection of sensitive information is reasonably necessary for one or more of our functions or activities, we will only collect sensitive information about you with your consent, or otherwise in accordance with the Privacy Act.

3. Our purposes for handling your personal information

As a general rule, we only process personal information for purposes that would be considered relevant and reasonable in the circumstances.

We collect, hold, use and disclose personal information to:

(a) respond to enquiries and communications;

(b) verify your identity if required;

(c) inform our customers and other business contacts about product, service and industry developments

(d) market and promote our developments and services;

(e) facilitate property sales and transactions;

(f) maintain sales, transaction and business records;

(g) undertake project administration and management;

(h) engage contractors, consultants and service providers;

(i) comply with our legal and regulatory obligations; and

(j) otherwise manage our business.

We may disclose personal information to third parties such as Elberton Property, our appointed real estate agents, sales agencies and representatives, or our suppliers, contractors, consultants or professional advisers involved in our developments, where permitted by the Privacy Act.  If we disclose information to a third party, we generally require that the third party protect your information to the same extent that we do.

We will not use or disclose your personal information for any other purpose unless you have consented to that use or disclosure, or the relevant use or disclosure is otherwise permitted by the APPs or some other law.

4. Protection of personal information

We take reasonable steps to protect your personal information we hold from misuse, interference and loss as well as unauthorised access, modification or disclosure.

We will hold personal information as either secure physical records, electronically on our intranet system, in cloud storage, and in some cases, records on third party servers, which may be located overseas.

We maintain appropriate physical, procedural and technical security for our offices and information storage facilities so as to prevent any loss, misuse, unauthorised access, disclosure, or modification of personal information.  This also applies to disposal of personal information.

We further protect personal information by restricting access to personal information to only those who need access to the personal information do their job.  Physical, electronic and managerial procedures have been employed to safeguard the security and integrity of your personal information.

We will destroy or permanently de-identify your personal information once it is no longer needed for a valid purpose or required to be kept by law.

5. Direct marketing

We may provide you with information about our property developments, projects, services, events, promotions or other opportunities that may be of interest to you.  We may send you this marketing or promotional communications by email, post or SMS.  You may ask not to receive such material from us by contacting us or by using the opt-out function included in those communications.

Note that if you opt-out of direct marketing messages from us, we may still communicate with you from time to time for other purposes, including where we:

(a) respond to any correspondence you send us;

(b) provide you with invoices or updates in respect of your property development;

(c) engage with our contractors and suppliers; or

(d) are legally required to provide you with notice of certain matters.

Where our appointed real estate agents or sales agencies manage enquiries or communications on our behalf, they may also send marketing communications in accordance with their own privacy policies.

We may also utilise the services of third parties to assist us with undertaking our direct marketing activities. 

6. Cookies

A cookie is a small text file stored in your computer’s memory or on your hard disk for a pre-defined period of time.  We use cookies to identify specific machines in order to collect aggregate information on how visitors are experiencing the Website. This information will help to better adapt the Website to suit personal requirements.  For information on cookie settings of your internet browser, please refer to your browser’s manual.

7. Accessing and correcting your personal information

You may contact us to request access to the personal information that we hold about you and/or to make corrections to that information, at any time.  On the rare occasions when we refuse access, we will provide you with a written notice stating our reasons for refusing access.  We may seek to recover from you reasonable costs incurred for providing you with access to any of the personal information about you held by us.

We are not obliged to correct any of your personal information if we do not agree that it requires correction and may refuse to do so.  If we refuse a correction request, we will provide you with a written notice stating our reasons for refusing.

We will respond to all requests for access to or correction of personal information within a reasonable time.

8. Overseas transfers of personal information

As at the date of this Privacy Policy, we are not likely to disclose your personal information to overseas recipients.

If in future we do propose to disclose personal information overseas, we will do so in compliance with the requirements of the Privacy Act.  We will, where practicable, advise you of the countries in which any overseas recipients are likely to be located.

If you do not want us to disclose your information to overseas recipients, please let us know.

9. Personal information about employees

We may collect personal information about our employees and prospective employees, as part of their application and during the course of their employment, either from them or in some cases from third parties such as recruitment agencies. 

This may include information about the employee’s health, their right to work in Australia, or other sensitive information.  For some roles, employees may need to obtain a security clearance or provide a criminal history search.

Under the Privacy Act, personal information about our current or former employees may be held, used or disclosed by us in any way that is directly connected to the employment relationship.  We handle information about our employees in accordance with legal requirements and our applicable policies in force from time to time.
